Since the historic Nuremberg Trial of 1945 there has developed an international customary law principle which requires that any commission of the core crimes under international law war crimes, genocide, crimes against humanity and aggression must not go unpunished. Although various initiatives, including the creation of the ICC, have been taken to enhance the fight against impunity, gross human rights violations in which the core crimes are committed remain serious problem. Previous experience shows that when such violations occurred in Africa, especially as a result of election disputes, national and regional actors, including the African Union, resorted to political rather than legal responses. However, when crimes against humanity were committed in Kenya during the 2007-2008 post-election violence, a promising road map for criminal accountability was agreed upon alongside a political solution. This book, examines the legal responses to these crimes in Kenya view of this road map. It identifies and analyses the legal issues, options and challenges arising as regards the prosecution of alleged main perpetrators in the domestic courts and at the ICC.
