Entering the new century with deepening domestic reform, and widening openness to the outside world, China needs a more globalized and diversified vision for the science of law. Constituting the Rule of Law in China explores this need in depth. The books presents the idea of a need to think differently from the two major western mainstream legal cultures, the Anglo-American and the continental systems. Other globalized, universalized and diversified models, and experiences in the rule of law from diverse civilizations, have much to offer China. Through learning from the strengths exhibited by systems in countries with a very developed and well-organized rule of law, and absorbing essential aspects from different countries, China might be well positioned to promote the development of the rule of law in a robust and comprehensive manner. Extended background for proposal purposes: The rule and study of law in China has been through significant development following reform and opening-up in 1978. This is in part due to the rapid popularization and widespread application of comparative methods. In law enforcement, in the judiciary and in legal supervision, the application of comparative methods, such as the method of agreement and the method of difference, has led to a broader outlook, deeper comparison, wider choice, and more effectual reference points for China to promote the rule of law and the study of law. The application of these methods has accelerated modernization in the legal system. In the initial years following reform and opening-up, the emphasis in developing China’s legal system was to study and draw upon the Anglo-American legal system and the continental legal system.
