This book throws light on the unrivalled synthesis of diverse legal traditions, realized by a charismatic creator of law, David Santillana. At the time of the establishment of the German Civil Code (BGB) in 1900, the French protectorate entrusted him with the task to provide the Tunisians with the Code des obligations et des contrats, which combines both the judicial rationality of the Occident and the legal thought of the Islamic-Arabian world. This encounter of the legal cultures thereby exposes a comprehension of the Islamic law within the judicial form of Occidental codification, which is usurped by the dominating group of the Ulama. The code adopts hybrids of Islamic law with the juristic forms of German, Swiss, and - first of all - French law. In this respect, this historic case is read as a "Lehrstück" of encounter and conflict of the legal cultures, which becomes increasingly relevant in the age of globalization. Die Arbeit beleuchtet die einzigartige Syntheseleistung eines charismatischen Rechtsschöpfers, von David Santillana, der zum Zeitpunkt der Entstehung des Bürgerlichen Gesetzbuches (1900) vom französischen Protektorat die Aufgabe übernahm, den Tunesiern einen Code des obligations et des contrats zu geben, in dem die juridische Vernunft des Okzidents mit derjenigen der islamisch-arabischen Welt vereinigt sei. In dieser Begegnung der Rechtskulturen schält sich ein Verständnis des islamischen Rechts in der juristischen Form okzidentaler Kodifikation heraus, das von der Trägerschicht der Ulama für sich usurpiert wird und nunmehr - mit Rechtsformen des deutschen, schweizerischen und vor allem: französischen Rechts - hybride Mischformen einnimmt. Insofern wird der historische Fall als ein Lehrstück von Begegnung und Konflikt der Rechtskulturen gelesen, die im Zeitalter der Globalisierung zunehmend an Bedeutung gewinnt.
